Union Mediation focuses primarily on personal injury claims in the field of medical negligence, public liability and institutional abuse, along with professional negligence claims. 

With Rob's additional experience in governance, risk management and contractual negotiations, primarily through his work for elite sporting bodies, facilitation of sporting and more commercial based disputes is also offered.  

Rob understands that matters may need to be rescheduled or cancelled at the last minute. If pre-reading, pre-mediation intake and preparation has been completed (and rescheduling is not anticipated), Rob reserves his right to:

  • charge 50% of his fees if cancellation occurs within two business days of the mediation date. 
  • charge his full fee if cancellation occurs on the day of mediation. 

Yes, the fee includes all of Rob's preparation/reading time, pre-mediation conferences and assistance to the parties post-mediation if settlement is imminent.

The mediation brief should include the exchanged pleadings, particulars of special damages, interrogatories, expert reports and letters of instruction, Medicare Australia Notice of Charge, interlocutory orders and details of any previous offers made. 

Once a mediation is confirmed, Rob will provide each party a link to a mediation brief for uploading of documents. 

Rob's preference is to receive the mediation brief no later than 7 business days prior to the mediation to ensure sufficient time to prepare and discuss with the parties. 

For in-person mediations, there are a number of suitable venues within the Melbourne CBD legal precinct. These include but are not limited to the Victorian Bar Mediation Centre, LIV Mediation Rooms and Karstens. Suitable suburban and regional venues can be provided upon request.  

All parties to an on-line mediation will be provided a Zoom or Teams calendar link for the booking date and time. All parties should ensure that they have access to a working video camera and microphone, and that they present from a noise free location with only those authorised to participate present.  Recording of the mediation is strictly prohibited.   

The parties are encouraged to agree on the video conferencing software prior to booking. 

Yes, a mediation agreement will be distributed to the parties' legal representatives in the week prior to the mediation. This helps preserve the integrity and confidentiality of the mediation process. For ease of use, the agreement will be distributed to all participants for e-signing.
